Submit a Claim - Claim Instructions

If you feel that you have suffered financial damages in excess of the automatic payment that you will receive or have received and that these damages were caused by mortgage forbearance that you received when you or your co-borrower were in Chapter 13 bankruptcy, you may ask for additional money by completing a Claim Form as described below.

If you are a co-borrower on your mortgage loan with someone else, and you suffered financial losses that are different than the other borrower on your loan, you may submit your own Claim Form.

For a Claim Form to be valid, you must submit documentation that supports your claim. All Claim Forms must be submitted online no later than January 7, 2025, or, if mailed, postmarked or received no later than January 7, 2025.

After submitting your completed Claim Form online, you will receive an email with a confirmation code for your completed submission. Receipt of a confirmation code means your Claim Form was successfully submitted. If additional information is required to complete your Claim, you will be contacted by the Claims Administrator.

How to File by Mail or Email:

If you wish to submit a Claim Form via standard mail, you may download a copy of the Claim Form here. You will need to provide all of the information requested on the Claim Form, sign it, and date it. Then, mail it to the following address:

Under the terms of this Settlement, your claim for additional financial compensation will be reviewed by the Claims Administrator and, to the extent appropriate, the Claims Ombudsman, who are responsible for administering the Claims Fund. Wells Fargo will not play any role or have any responsibility whatsoever in the processing, review, consideration, or decision of your claim.

Filing a claim does not guarantee that you will receive any additional payment. For a claim to be determined to be valid, it must be appropriately documented and reasonably attributable to Wells Fargo’s placement of your loan in forbearance.

Consequently, your failure to adequately document your claim may result in denial of your claim, in whole or in part. The Claims Ombudsman has the right but not the obligation to contact you directly regarding your claim in order to obtain additional documentation from you supporting the nature and/or amount of the claim, the basis for the claim and other information about your claim. Your failure to assist the Claims Ombudsman in this process could result in denial of your claim in whole or in part.

By filing a claim, you understand that the decision of the Claims Administrator and/or Claims Ombudsman regarding the allowance and amount of your claim is final and binding on you and that you have no right to appeal their decision. Therefore, it is critical that you thoroughly document the amount and nature of your claim and assist the Claims Ombudsman to the extent necessary to verify and calculate the amount of your claim.

To the extent that the total amount of allowed Valid Claims exceeds the amount available to pay allowed claims, the Valid Claims will be paid from funds available on a “pro-rata” basis.



Remember, all Claim Forms must be submitted online or received by the Claims Administrator no later than January 7, 2025.
